WORK MEETING

OCTOBER 30, 2007

SMR MEMBERS PRESENT: Terry Behunin, Everett Taylor, Jeff Mendenhall, Max Henrie, Ted Barbee

SMSSD MEMBERS PRESENT: Terry Behunin, Frank Fraser, Monte Pugmire, Roy Slater, Jay Hansen

ITEMS OF BUSINESS:

Discussion took place on changes made to the agreement to update the lease between SMR and SMSSD.  Frank Fraser stated that he, Jay Hansen and Roy Slater had met with Ross Blackham, Sanpete County Attorney, to discuss the draft wording of the lease. Mr. Blackham was in favor of rewording some parts of the lease. Mr. Blackham expressed concern that paragraph 6 under Section IV wan not in compliance with statute as written. He also recommended eliminating Section III – 4C. Frank Fraser presented a draft of the Lease in legislative format showing the proposed changes.

Max Henrie suggested that both groups lawyers should meet to work out the wording of the lease, was later supported and agreed upon by all members present.

Other items discussed: Proposed snowmobile parking lot and improving existing snowmobile parking lots and road care.  Concern was stated over winter parking congestion and use of snowmobiles, trailers, etc.

Max Henrie made a motion to the SMR Board to enlarge the existing snowmobile parking lot. Motioned seconded by Terry Behunin.  Vote was unanimous.

Everett Taylor gave approval of purchasing an adapter for the trailer and spreader; remind Joe to move the sensor father away from the upper gate.

Frank Fraser stated if there are any issues reported with the roads, give these complaints to SMSSD in writing and then they will respond.

Max Henrie stated that Legacy found water and to be ready to file a protest and suggested that SMSSD file this protest after the official notice is advertised in the paper.   Everett Taylor agreed to find out which company was responsible for the drilling.

Everett Taylor closed the meeting with SMSSD, and then proceeded to conduct SMR business.
